Terms of Use
To access the Annual Statement Portal, you must read and accept these Terms and Conditions.
Note: Creating inauthentic or test profiles is not allowed and may result in loss of access.
1. About the Portal
- The Portal provides regulated employers a method to submit their annual statements to the Office of the Pay Equity Commissioner (OPEC).
- The Canadian Human Rights Commission (CHRC) may limit the number of Portal users for an employer.
2. Acceptance of Terms of Use
- In these Terms, “you” refers to individuals who have been authorized by a regulated employer to access and use the Portal on that employer’s behalf.
- By using the Portal, you agree that you are acting on behalf of a regulated employer and that you have the authority to do so.
- By accessing this Portal, you agree to these Terms of Use for the Portal and to the CHRC privacy notice found on the CHRC website (collectively referred to as the "Terms").
3. Your Responsibilities
- You must use the Portal only for lawful and authorized purposes. You are responsible for ensuring that you use the Portal in compliance with the Terms.
- You must not create an inauthentic or test profile. Individuals responsible for any such profiles may have their Portal access revoked.
- You must provide accurate information and comply with all laws and these Terms.
- You must notify OPEC immediately if you believe these Terms have been breached or if any security incident has occurred.
- You are responsible for reviewing these Terms regularly for any updates.
4. Security Requirements
- You must keep your login information confidential and not share it with others.
- You must take reasonable steps to protect your login information and report any suspected compromise of this information.
- You must not interfere with the Portal or transmit viruses, malware, or harmful code.
5. How Your Information Will Be Used
- You agree to receive notifications through the Portal or by email.
- The Pay Equity Commissioner may use your information to verify compliance with the Pay Equity Act, for program management, and for research.
- Your information may be included in reports to the Minister or Parliament about systemic or emerging pay equity issues and that this information could be tabled in Parliament.
- Draft annual statements not submitted by December 31 will be deleted to maintain data integrity.
6. Terminating Access
- OPEC may end your access to the Portal as an individual user if you
- provide false or incomplete information;
- have compromised login information;
- no longer represent the employer;
- send or may have sent harmful code, like viruses, malware, worms, or spyware, whether on purpose or by mistake, or otherwise disrupt the Portal; or
- fail to follow these Terms.
7. Liability
- The OPEC is not responsible for issues outside its control, including network outages.
- The OPEC is not responsible for illegal or fraudulent use of your login information.
- The OPEC is not liable for any claim in relation to the use of the Portal, except for any acts or omissions that result from its gross negligence or willful misconduct.
8. Changes to the Terms
- The OPEC may update these Terms at any time. Updates take effect when posted in the Portal.
- If any part of the Terms is found to be invalid, all other terms still apply.
- A failure to enforce a provision of these Terms is not considered a waiver of the Terms.
